Terms and Conditions – Boxhy

Article 1 – Definitions
1. Entrepreneur: Boxhy B.V., established in Amsterdam, trading under the name Boxhy.
2. Customer: any natural or legal person who enters into an agreement with the entrepreneur.
3. Agreement: any distance or offline purchase agreement between Boxhy and the customer regarding the sale of products.
4. Products: boxer shorts, sportswear and related items.
5. Website: the webshop accessible via www.boxhy.nl.

Article 2 – Applicability
1. These terms and conditions apply to all offers, orders and agreements, both online via the website and offline via Boxhy.
2 retail channels. Deviations from these terms and conditions are only valid if agreed in writing.
3. The latest terms and conditions can be found on the actual website. Those prevail under all circumstances.

Article 3 – Offer and prices
1. The offer contains a clear description of the products offered.
2. Prices include VAT and exclude any shipping costs, unless otherwise stated.
3. Boxhy reserves the right to change prices, with the exception of agreements already concluded.

Article 4 – Agreement
1. The agreement is concluded at the time of acceptance of the offer by the customer and the fulfilment of the set conditions (including payment).
2. Boxhy confirms the agreement by e-mail.

Article 5 – Delivery
1. Delivery takes place at the address provided by the customer.
2. Boxhy aims to ship orders within [x] business days.
3. If delivery is delayed or cannot take place, the customer will be notified as soon as possible.

Article 6 – Right of withdrawal (consumers, online purchases only)
1. The customer has the right to terminate the agreement within 7 days of receipt without giving reasons.
2. During this period, the customer will handle the product and its packaging with care.
3. Products can only be returned if they are unused and in the original packaging, with attached label.
4. Hygiene products such as boxer shorts may only be returned if the seal has not been broken and not be used in any way.

Article 7 – Returns and Costs
1. The costs for return shipping are borne by the customer, unless the product is defective or incorrectly delivered according to the supplier.
2. Boxhy will refund the purchase price within 14 days of receipt of the return.

Article 8 – Payment
1. Payment must be made via the payment methods offered on the website or in the store.
2. In the event of late payment, Boxhy reserves the right to charge collection costs.

Article 9 – Warranty and Liability
1. Boxhy guarantees that the products comply with the agreement and with the legal provisions on conformity.
2. Boxhy is not liable for damage caused by incorrect use of the product.

Article 10 – Complaints procedure
1. Complaints must be submitted to Boxhy in a complete and clearly described manner within a reasonable period of time.
2. Boxhy aims to respond to complaints within 14 days.

Article 11 – Applicable law
1. All agreements are exclusively governed by Dutch law.
2. Disputes are submitted to the competent court in the district of Amsterdam, unless the law prescribes otherwise.
